Please read these Terms carefully as by booking any Product with Given2Fly or by travelling on a Given2Fly tour or Product you acknowledge that you: i) have read and understand these Terms, and ii) indicate your express acceptance of and agree to be bound by these Terms. If you have confirmed a booking on any Products with more than one client named and booked on such booking, you shall be deemed to have accepted these Terms and Conditions (the “Terms”) on behalf of all clients named in the booking (including minors and those under a disability) and travelling on or otherwise participating in any Products (hereinafter “you”, the “Client(s)”), and by such travel or participation all passengers indicate their assent to these Terms. The client who confirmed the booking is deemed to be the designated contact person for all other clients named in such booking.
1. Subject of Contract
The subject of this contract is the regulation of mutual relations between Given2Fly, obrt za usluge i turizam (here and after Given2Fly ) and the CLIENT respectively the contractor of the travel package/activity and /or services in cases where the contractor of the travel package/activity signs the contract in favor of a third party client as well as the CLIENT as the passenger, the end-user of Gien2Fly’s services (hereand after CLIENT).
The contract is considered binding after the Given2Fly employee and the CLIENT have signed it and after the CLIENT has paid the price of the travel package/activity in its entirety or partially with undisputed insurance of payment of the balance by the agreed upon date. If the CLIENT is unable to personally sign the contract, the contract shall take legal effect only when Given2Fly receives contracted payment for the travel package/activity and/ or services in its entirety or if it has been expressly agreed upon, part of the contracted payment accompanied by documentation that indisputably insures the payment of the balance by the agreed upon date. When signing the contract the client is obliged to provide personal data and duly provide all the documentation necessary for the organization of the travel package/activity and /or service.
2. Reservation and Payment
By making an ONLINE reservation/booking via the Agency web page booking system, you are expected to pay the full amount at once for all the products. Once you go to checkout and click pay now, you will get a confirmation email, with trip details and your ticket.
The payment via Agency ONLINE reservation/booking system is done via Pay Pal, if you desire to pay by Bank transfer, please contact us directly.

3. Price
Given2Fly activity prices are based a contract basis with our partners and do not necessarily match the prices stated on site therefore any difference in price may not be the subject of a complaint.
Given2Fly may require an increase in the contracted price up to 21 days before the date of the selected activity if changes in the exchange rate have occurred after the signing of the contract or if there is an increase in the entrance fees, transportation costs, including fuel expenses or tax expenses that Given2Fly was unaware of or unable to be aware of.In that case the prices of the selected activity will increase reciprocally to the prices of the calculated elements that were used to as a base to form the price. The client agrees to accept the increase in the contracted price up to 10%. If there is an increase in the contracted price of more than 10% the client has the right to withdraw from the selected activity, provided that GIVEN2FLY is notified in writing no later than 2 days from receiving notice of the price increase. In case of withdrawal from the selected activity, the client is not entitled to compensation. If the client does not notify GIVEN2FLY in writing of his/her withdrawal within the stated deadline, it is considered that he/she agrees to the price change. The prices of our tour are listed in HRK – which is the official Croatian currency. However, while booking you can chose whether to pay in EURO or HRK. The system will show you both of the prices.
4. Accident insurance
Pursuant to the Act on the Provision of Tourism Services in Adventure Tourism (article 56, paragraph 3) GIVEN2FLY has a binding accident insurance policy with Generali Osiguranje D.D. (policy number: P41-1020027613).
5. Travel Insurance
Due to specificity of activity, we strongly recommend Trip Insurance from a reputable company. Coverage is reasonably priced and can cover your expenses in the event you need to cancel your trip or your trip is affected by acts of nature.
CLIENT ACKNOWLEDGES THAT IS MANDATORY THAT ALL CLIENTS OBTAIN TRAVEL INSURANCE WITH A MINIMUM MEDICAL, EVACUATION, AND REPATRIATION COVERAGE OF US$20,000 covering all applicable dates of any travel with Given2Fly and this insurance must cover personal injury and emergency medical expenses. Given2Fly reserves the right verify that all Clients have such insurance in place and coverage as per the required amounts above. It is strongly recommended and encouraged that Client’s also extend their coverage to include cancellation, curtailment, and all other expenses that might arise as a result of loss, damage, injury, delay or inconvenience occurring to the Client. The Client acknowledges that the cost of the tour does not include any insurance coverage for such Client, and that the Client is required to obtain separate coverage at an additional cost to the Product tour price. When obtaining travel insurance the Client must ensure the insurer is aware of the type of travel to be undertaken so that the insurer may properly cover travel on the applicable Given2Fly Product.
6. Extreme weather conditions
We reschedule the activity in case of extreme weather conditions, extraordinary circumstances, which could not have been foreseen or avoided, or have occurred immediately. The activity is than rescheduled for a day or two – prior or after the date booked. If the change is not possible, the payments will be refunded in full amount.
7. Cancellation by Client
If a client cancels a paid travel package/trip, GIVEN2FLY is entitled to retain the following amounts of the total price of the travel package:
ALL cancellations must be in writing – by e-mail.
If the Client should cancel or abort the booked tour, all Client’s cancellations must be in writing. By e-mail. The written cancellation date shall be the basis for the compensation of cancellation costs. As per conditions set below (percentage of total arrangement price):
8 or more days prior to arrival: 0%
2-7 days prior to arrival: 50%
1 day prior to arrival or no show: 100%
Failing to make appearance and travel without prior cancellation shall entitle the Agency to withhold 100% of the payment made regardless of the reason for cancellation.
8. Changes to the Activities
Considering the activities that are offered, GIVEN2FLY reserves the right to make changes to trips, accommodations and itineraries at any time. Although it is unlikely that everything might change, usually it is a matter of minor changes. If there are major changes and addendums the client shall be informed prior to any changes being made. GIVEN2FLY will always endeavor to provide the activities according to the original planned program.
9. Cancellation by Given2Fly Adventures
GIVEN2FLY reserves the right to cancel trips. If we are forced to cancel a trip we will attempt to find an adequate replacement. However GIVEN2FLY may not be held liable for any other losses incurred as a result of the cancellation of the planned activity.
Agency cancellation policy
Our tours itineraries are subject to change depending on group abilities and preferences but also weather conditions, water levels, other acts of God, special events of interest and similar. For Client’s safety and comfort reasons, the Agency reserves the right to alternate program without prior notice. In case of major changes or cancellations of a specific program booked by the Client, the Agency will advise the Client as soon as possible and provide the following options:
a) Client may accept a new departure date or destination
b) Client may accept a replacement package/excursion of equivalent or closely similar itinerary
c) Client may cancel his/her booking altogether and receive a full refund of the money paid
It is your duty to inform us about your decision within 7 days of the offer. If the Client doesn`t do that, the Agency will book a replacement tour.
10. Liability and Personal Safety/Equipment
GIVEN2FLY employees exclusively qualified personnel. All members must have passed courses in first aid and mountain rescue. Also, GIVEN2FLY guides carry with them complete gear necessary for the execution of certain activities. GIVEN2FLY recognizes and advises considering the nature of the offered activity that accidents are possible and that all clients must be aware of the risks. GIVEN2FLY may not be held liable for circumstances outside of its scope of influence and participation in activities is at the risk of the client. Clients are obliged to take with them basic personal equipment as detailed on the GIVEN2FLY website under the category “what to bring”. Depending on the activity that the client chooses, GIVEN2FLY will in a timely manner send a list of equipment the client must bring along. The client is obliged to, in a timely manner prior to the activity, inform GIVEN2FLY or possible lack of basic equipment so that GIVEN2FLY may attempt to procure the equipment that the client is lacking. All of the equipment will be inspected prior to the activity, and GIVEN2FLY mountain guides have the right to refuse participation of clients on the trip if they do not have the basic equipment, without refund. Safety of the client comes first and in these cases the decision of the mountain guide is final. The client may at any time contact GIVEN2FLY regarding equipment needs and we will happily offer all necessary information.
In the case of borrowing or renting equipment, the customer is required to return the equipment in the same condition as it is received. In case of loss of equipment, the customer is required to pay the full value of the borrowed/rented equipment.
11. Medical Regulations
The client is obliged to inform GIVEN2FLY of any known medical problems that may affect the client during the selected activity. GIVEN2FLY will send a medical release form to the client prior to the activity and the client will return it to GIVEN2FLY in the shortest possible time frame. The information stated in the form is confidential and serve the sole purpose of informing the mountain guide of the health condition of the client.
All clients are obliged to confirm good physical and mental health and that they are able to participate in the selected activities. Clients must be aware that most of the activities require exertion.
If the client is younger than 18 years of age GIVEN2FLY requires parental consent in order for an under-age individual to participate in selected activities.
12. Settlement of Disputes
Clients are guided by qualified GIVEN2FLY guides and agree that the guide’s decision is final. The guide will guide participants in all situations during the activity.
GIVEN2FLY reserves the right to refuse to allow clients to participate with the group during the execution of activities. The reasons may be: illegal activity, irresponsible behavior which endangers the entire group, the guide or any other clients. In this case, GIVEN2FLY will not accept any further responsibility and will not be responsible for the client’s expenses. In this case the client also does not have any right to a refund for any part of the trip.
If the client considers the service unsatisfactory, he/she has a right file a complaint to GIVEN2FLY. Complaints must be filed in writing within 5 days of the offered service. Upon expiration of the 5-day period it will be determined that the client is satisfied with the services. We emphasize that it is in the client’s interest to act with positive intentions and demonstrate willingness to resolve complaints during the trip and to direct the complaint to the service provider on site. Please contact your tour leader/guide or representative immediately if the tour services are incomplete or executed below standard. Each client files a complaint separately. GIVEN2FLY will not take into consideration group complaints. GIVEN2FLY is obligated to offer a written resolution to the complaint within 15 days of receiving the complaints in the same manner that the complaint was received (e-mail, post or personal delivery which will be delivered by post with receipt of acceptance).
GIVEN2FLY will consider and resolve only those complaints that are delivered with evidence that the written complaint was submitted to the service provider on site and that the cause was not able to be resolved on the site. If due to the fault of GIVEN2FLY the program was unable to be fulfilled or some part of the service was not fulfilled, the client has a right to compensation in the amount of the true value of the unused services and it may not include already received services nor the entire amount of the travel package/activity. Until GIVEN2FLY makes a decision regarding the complaint, the client refrains from mediation by any other person, court or giving information to the media.
13.Court jurisdiction
You have the right to judicial arbitration. The Client and the Agency will aim to settle possible law suits. Agreements not reached, become subject of the Split Court jurisdiction – nder the authority of the laws of the Republic of Croatia.
14. Risks
Outdoor activities carry with them certain risks. As a responsible provider of outdoor activities, GIVEN2FLY underlines the possible risks for clients while participating in selected activities on mountain terrain.
GIVEN2FLY and its staff consider the health and safety of the client very seriously, but it is not possible in these activities to completely eliminate the risk. We will state some of the dangers that may occur during the execution of selected activities. Clients should be aware that accidents in such circumstances may lead to serious injuries and in extreme situations death:
Physical and psychological exertion
Adverse weather conditions (wind, rain, snow, strong wind, strong sun, storms, lightening etc.)
Irregular, slippery and dangerous surfaces (rock, rock slides, ice, grass, sink-holes, chasms etc.)
Road traffic, traffic accidents
Rock avalanche, rock slides
Strong sun, UV radiation
The goals of a certain activity (the peak, a specific route, time-frame, etc.) may not be possible to achieve in adverse weather conditions. GIVEN2FLY will not be responsible for such situations in the field. Conditions on outdoor activities can be unpredictable and that must be made clear to all clients. The safety of the clients and the group must come before any goals of the selected activity.
The GIVEN2FLY guide is responsible for all decisions during the planned activity. His/Her decisions on the choice of route as well as decisions regarding the continuation of an activity and participation of clients in the activity are final. It is possible for the guide to make changes in the route in a short time due to fast changes in weather conditions. Clients must be aware that sudden changes in weather conditions on a mountain or a sea may occur during any season. GIVEN2FLY will make every effort to proceed according to the planned program when that is possible. That, however may never be a guarantee.
15. Images and marketing
The Client agrees that while participating in any Given2Fly Product tour (including, without limitation, group and Independent travel, multi-day expedition trips, self-guided trips and other tour product) images, photos or videos may be taken by other Clients and/or Given2Fly representatives or Tour Leaders that may contain or feature the Client in part or in whole. The Client acknowledges that they consent to any such pictures being taken and agree that Client hereby grants a perpetual, royalty-free, worldwide, irrevocable license to Given2Fly, its affiliates and assigns, to reproduce for any purpose whatsoever (including marketing and promotions), in any medium whatsoever, whether currently known or hereinafter devised, without any further obligation to the Client or compensation payable to such Client.
16. Personal Data Protection
The clients voluntarily discloses personal data. Personal data on passengers is necessary in the process of realizing contracted travel packages and will be used for further communication purposes.

Stand up paddle board or/ and kayak ( SUP ) and / or Kayak Hire
This rental policy aims to clarify the risks and responsibilities for you and us when booking and undertaking an adventure tour.
1. ELIGIBILITY
Before renting a stand up paddle board or/ and kayak, you may be required to demonstrate your experience and knowledge by answering some safety related questions. Every equipment rented is required to have an appropriate safety leash for each occupant carried on the craft at all times. Given2Fly will offer life jackets with each vessel.
Please note: you may be required to provide practical demonstration of your paddling and rescue skills prior to hiring. Given2Fly reserves the right to limit the areas in which rental clients can paddle and/or refuse hire due to adverse weather conditions or if a client is unsuitable due to age, size, ill health or poor fitness.
2. SKILLS AND EXPERIENCE
Nature may be beautiful and inspiring, but it is not always gentle, sea conditions can change quickly. As such, unguided SUP and / or kayak rentals are suited to experienced and confident paddlers only who understand sea conditions and how to manage risks.
Participants in our rental program are required:
To understand sea conditions and the risks involved in the activity.
To wear a safety leash at all times while on the vessel.
To understand the vessel and how to use the safety equipment.
To be able to swim and rescue themselves in deep water.
To protect environment by not leaving litter on beaches.
To pay close attention to avoid collisions with other users of the water i.e. motorboats, jet ski, water ski, kayaks, and swimmers.
To pay close attention to other dangerous situations such as strong currents, tide, flood, poor weather,
waves, unstable cliffs. To make sure all children supervised of an adult at all times.
To place all equipment in a safe place when stopping and/or getting off the SUP board or kayak.
Not being under influence of alcohol or drugs before or during stand up paddle board or/ and kayak rental.
3. BOOKINGS AND PAYMENTS
We will accept and hold unconfirmed reservations for a limited period of time. Your booking will not be confirmed until we receive your completed Booking Form and deposit or full payment. The deposit (50% of total cost) must be paid within 4 working days of returning this completed form in order to secure the dates. Reservations may expire if a deposit is not received by that date.
4. RATES
No refunds will be made due to equipment returned early or for equipment hired but not used. SUP hire includes single SUP, safety leash and paddle.The followings are provided per groups: maps, weather forecast. We recommend bringing: dry clothes, towel, food, water, sun cream, communication device. Other beach equipment is available to hire: snorkelling gear.
Kayak hire includes duble kayaks, 2 paddles amd life vest.
5. SUBLEASING PROHIBITED
Customer understands and agrees that any subleasing or re-letting of rental equipment is prohibited and that any such sublease or re-letting shall immediately cause termination and cancellation of this contract.
6. LATE FEES
Equipment returned late will incur a charge of € 10 per hour when returned after the agreed upon return time/date unless otherwise arranged with Given2Fly.
7. SECURITY DEPOSIT
Credit card details and a photocopy of the hirers licence are required as security and will be returned at the completion of the hire. If the customer prefers not to leave his/her passport and/or credit card details, Given2Fly will accept a cash deposit of € 250 per Air SUP and kayak, and € 500 per Hardboard SUP. The deposit will be re-funded if the rented equipment is returned in the same conditions it was procured.
We ask you to respect our sport equipment while it is in your possession. The stand up paddle board or/ and kayaks must be treated with care. Do not drag them, and be particularly careful when launching or recovering across rocks or uneven ground. Please return all equipment in good condition and report any problems you had, damage caused and/or any repairs needed. The renter will be charged for repairs or replacement of damaged or lost equipment. Given2Fly reserves the sole right to determine the condition returned.

8. CANCELLATION POLICY
We understand you may need to change your rentals, possibly at short notice and we may need to change our rental due to safety reasons or comfort. Given2Fly reserves the right to cancel your booking prior to departure due to adverse weather conditions or forecasts. On this event, you will be notified as soon as possible and given the option of transferring to another date or receiving a full refund. Fares will not be refunded for short notice cancellation or if clients miss their vessel pick up time due to late arrival. Please tell us if it becomes necessary to cancel your booking.
The following cancellation fees may apply:
Less than 14 days prior to date – 100% rental cost charged
15-30 days prior to date – 50% of rental cost charged
More than 30 days – rental cost fully refunded
